Expunge California – Expungements & Certificates of Rehabilitation**

1. Service Overview

Expunge California (“Company”) provides document preparation, case review, petition drafting, and filing assistance for:

  • Penal Code §1203.4 Expungements (Dismissals)

  • Penal Code §4852 Certificates of Rehabilitation

  • Record Sealing Services (Penal Code §851.91)

 All services are administrative, clerical, and based on publicly available legal procedures.

 

2. Eligibility Requirements

The client is responsible for providing accurate and complete information. Eligibility for expungement or rehabilitation depends on California law, including but not limited to:

  • No open cases

  • No active probation or parole (unless legally eligible)

  • Completion of all sentencing requirements

  • Compliance with waiting periods (for Certificates of Rehabilitation)

If the client provides false, incomplete, or misleading information, the money‑back guarantee does not apply.

 

3. Scope of Services

The Company agrees to:

  • Review client intake information

  • Verify eligibility based on provided information

  • Prepare petitions, declarations, and supporting documents

  • Submit filings to the appropriate court or agency

  • Communicate updates received from the court or DOJ

  • Provide administrative support throughout the process

 

4. Client Responsibilities

The client agrees to:

  • Provide truthful and complete information

  • Respond to requests for documents or signatures

  • Pay all required fees on time

  • Attend any hearings if required by the court

  • Complete Live Scan fingerprinting when applicable

Failure to cooperate may delay or prevent filing.

 

5. Fees & Payment Terms

Expungement Fees

  • Misdemeanor: $599

  • Felony: $799  Payment plans are available. A minimum 50% deposit is required to begin work.

Certificate of Rehabilitation Fees

  • Standard Application: $1,299

  • Payment plans available.

Record Sealing Fees

  • Standard Seal: $599

All fees cover document preparation, filing assistance, and administrative support.

Court filing fees (if applicable) are not included unless stated otherwise.

 

6. Processing Timeline

Typical timelines:

  • Expungements: 60–90 days

  • Record Sealing: 3–6 weeks

  • Certificates of Rehabilitation: 2–6 months

Timelines vary by county, court workload, and DOJ processing speed. We cannot control court delays.

 

7. Money‑Back Guarantee

We only offer a full refund of service fees only under the following conditions:

Refund Applies If:

  • We determines the client is not eligible before filing, based on accurate information provided.

  • We are unable to process or file the petition due to our error.

Refund Does NOT Apply If:

  • The client provides false or incomplete information.

  • The client fails to complete required steps (Live Scan, signatures, payments).

  • The court denies the petition based on the judge’s discretion.

  • The client becomes ineligible due to new arrests, charges, or probation violations.

  • The client requests cancellation after work has begun.

Refunds apply only to service fees, not court fees, mailing fees, or third‑party costs.

 

8. Final Decisions

 Final decisions are made solely by:

  • The Superior Court

  • The District Attorney

  • The Department of Justice

  • The Governor (for Pardons)

 

9. Privacy & Confidentiality

All client information is kept confidential and used only for case processing. Documents may be shared with courts, DOJ, or law enforcement agencies as required.

 

10. Limitation of Liability

We are not liable for:

  • Court delays

  • DOJ delays

  • Denials based on judicial discretion

  • Client failure to follow instructions

  • Changes in law or policy

Liability is limited to the amount paid for services.

 

11. Agreement

By paying for services, the client acknowledges and agrees to these Terms & Conditions.
